This Website and the Evoforge brand are owned, manufactured, and operated by MK Pumps Industries, an industrial manufacturing entity registered under the laws of India, with its manufacturing facility and corporate office located at Saraswati Industrial Estate, B-2, near Sangam Hotel, Partapur, Meerut, Uttar Pradesh 250004.

1. Who Can Use This Website

By using this Website, you confirm that you are at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872.

As Evoforge primarily operates on a Business-to-Business (B2B) and factory-direct model, if you are purchasing equipment on behalf of a commercial gym, franchise, or corporate facility, you represent that you have the legal authority to bind that business entity to these Terms.

2. Our Products & Engineering Disclaimer

Evoforge manufactures heavy industrial strength equipment, including high-tensile barbells, weight plates, and gym hardware.

  • Assumption of Risk: Strength training and heavy lifting are inherently dangerous activities. Evoforge equipment is designed to withstand immense physical stress, but the user assumes all risks associated with lifting heavy iron.
  • Proper Usage: Our equipment must be used strictly for its intended biomechanical purpose. You must ensure your facility utilizes proper flooring (e.g., high-density rubber drop mats) and safety equipment (e.g., power rack safety pins).
  • Liability Exclusions: Evoforge and MK Pumps Industries are not liable for any physical injury, joint damage, or facility property damage resulting from poor lifting technique, improper use, failure to maintain rotation mechanics (sleeves/bushings), or intentional abuse of the equipment.

3. Permitted Use

You may use this Website to evaluate and purchase our industrial equipment. You strictly agree not to:

  • Reproduce, sell, or commercially exploit any content, CNC blueprints, or product designs from this Website without our written permission.
  • Use automated tools (bots, scrapers) to extract our pricing or engineering data.
  • Upload or transmit any harmful, unlawful, or infringing content.
  • Use the Website in violation of the IT Act, 2000 or any other applicable Indian law.
  • We reserve the right to suspend or terminate your B2B purchasing access without notice if you breach these Terms.

4. Accuracy of Specifications & Pricing

While we enforce strict multi-axis CNC machining and weight calibration tolerances on our factory floor, microscopic variances in steel batches or finishes may occur.

  • We strive to keep all engineering specifications (MPa ratings, shaft diameters, weight tolerances) and pricing completely accurate. We reserve the right to correct or update manufacturing specs at any time without prior notice.
  • In the event of a pricing error on an order you have placed, we will notify you and give you the option to confirm at the correct price or cancel for a full refund prior to factory dispatch.

5. Intellectual Property

All content on this Website, including the "Evoforge" name, brand assets, product photography, engineering specifications, written content, and logos, is the exclusive property of MK Pumps Industries, protected under the Trade Marks Act, 1999, the Copyright Act, 1957, and other applicable intellectual property laws. Unauthorised reproduction or distribution of any content or hardware design is strictly prohibited and will result in legal action.

6. Strict No-Refund & Freight Policy

By purchasing through this Website, you agree to our strictly enforced Return and Refund Policy. All B2B and D2C sales are final. Evoforge does not accept returns or issue financial refunds for buyer's remorse, facility miscalculations, or any other reason once an order is processed. Liability for transit damage or manufacturing defects is resolved strictly through factory component replacement, as detailed in our Return Policy.

7. Limitation of Liability

To the maximum extent permitted by applicable law, MK Pumps Industries, its directors, engineers, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, facility downtime, or business opportunities.
  • Any physical injury, strain, or medical condition arising from the use or misuse of Evoforge equipment.
  • Any property damage caused by dropping, storing, or installing the equipment.

In any event, Evoforge's aggregate liability for any claim arising out of or relating to these Terms shall strictly not exceed the total amount paid by you for the specific equipment giving rise to the claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless MK Pumps Industries and its personnel from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

  • Your (or your facility members') use of the equipment in violation of these Terms or basic safety standards.
  • Your violation of any applicable law or regulation.

9. Your Personal & B2B Data

We handle your personal and commercial data in accordance with applicable Indian digital privacy laws. By using this Website or submitting a B2B freight inquiry, you consent to data processing for order fulfillment and logistical coordination.

11. Governing Law & Jurisdiction

If unresolved, the dispute shall be subject to the exclusive jurisdiction of the courts located in Meerut, Uttar Pradesh, India.

12. Changes to These Terms

We may update these Terms at any time to reflect changes in our manufacturing or supply chain policies. Changes take effect immediately upon posting. Continued use of the Website after any changes constitutes your acceptance of the revised Terms.
